GENERAL SERVICE AGREEMENT

1. BOOKING & PAYMENT

A booking is not considered secured until the applicable service agreement has been signed and all required booking payments or retainers have been received.

Payment requirements vary depending on the service or collection selected and will be communicated prior to booking.

Payments, retainers, and amounts paid toward specialty or promotional sessions may be non-refundable as outlined in the applicable service agreement.

2. CANCELLATIONS & RESCHEDULING

Cancellation and rescheduling policies vary by service.

Clients are responsible for communicating cancellation or rescheduling requests as soon as reasonably possible. Rescheduling is subject to Photographer availability and the terms of the applicable service agreement.

Specialty, promotional, and mini sessions may have more limited cancellation or rescheduling options.

3. SESSION & COVERAGE TIME

Photography coverage begins and ends according to the time stated in the Client's booking or service agreement.

Late arrival, delays, lack of cooperation, or circumstances outside of the Photographer's control may reduce available photography time or affect the Photographer's ability to capture requested images.

Additional coverage may be available depending on Photographer availability and may be subject to an additional fee.

4. DELIVERABLES

Image quantity, gallery turnaround time, sneak peeks, video content, and other deliverables vary by service and collection.

Final images are professionally selected and edited by the Photographer and delivered according to the terms of the applicable service agreement.

RAW, unedited, rejected, or duplicate images are not provided.

5. EDITING & CREATIVE CONTROL

The Photographer retains creative discretion regarding photography style, posing and direction, lighting, composition, image selection, editing, and final presentation.

Standard editing may include reasonable adjustments to color, exposure, cropping, skin, teeth, hair, and other elements consistent with The Captured Company LLC's established editing style.

Extensive retouching, body modification, major object removal, image reconstruction, AI-generated alterations, or other substantial manipulation is not included unless specifically agreed upon.

6. CLIENT RESPONSIBILITIES

Clients are responsible for arriving prepared and communicating important requests, accessibility needs, scheduling considerations, or other relevant information prior to services being rendered.

Clients are also responsible for the cooperation and preparedness of individuals participating in their session or event.

When required, Clients are responsible for securing and maintaining appropriate permits, permissions, admission, location access, or other authorization necessary for photography services.

7. COPYRIGHT & IMAGE USE

The Captured Company LLC retains copyright ownership of photographs created by the Photographer.

Clients receive usage rights as outlined in their applicable service agreement and may not sell, substantially alter, apply filters to, or otherwise misrepresent the Photographer's finished work without permission.

The Photographer may use photographs for portfolio, website, social media, advertising, publication, and other business or promotional purposes unless otherwise agreed upon in writing.

8. LIMITATIONS & UNFORESEEN CIRCUMSTANCES

While every reasonable effort is made to provide services as agreed, the Photographer cannot guarantee specific photographs or moments when circumstances outside of the Photographer's reasonable control interfere with coverage.

These circumstances may include, but are not limited to, weather, venue restrictions, schedule changes, lateness, lack of cooperation, interference by participants or third parties, emergencies, equipment issues, or other unforeseen circumstances.

Specific limitations of liability and remedies are governed by the Client's applicable service agreement.

9. TRAVEL, LOCATIONS & ADDITIONAL SERVICES

Travel fees, location fees, permits, additional coverage, additional participants, specialty editing, and other optional services may carry additional charges.

Applicable fees will be communicated according to the selected service, location, and booking requirements.

10. SPECIAL & PROMOTIONAL SERVICES

Mini sessions, seasonal offerings, promotional sessions, special sets, and other limited services may be subject to separate booking requirements, payment policies, rescheduling limitations, deliverables, or promotional terms.

Any complimentary items, gifts, special sets, products, or other additions associated with a particular offering are subject to availability and are not guaranteed unless specifically included in the Client's booking.

11. SERVICE-SPECIFIC AGREEMENTS

This General Service Agreement provides an overview of The Captured Company LLC's standard service policies and is not intended to replace the agreement issued for a specific booking.

The terms contained in the Client's signed service agreement, invoice, and confirmed collection details govern the individual booking.

By booking services with The Captured Company LLC, Clients acknowledge that they are responsible for reviewing and agreeing to the terms applicable to their selected service.

12. CLIENT CONDUCT & SAFETY

Clients and participants are expected to maintain respectful, safe, and appropriate conduct throughout all services provided by The Captured Company LLC.

The Photographer will not be required to participate in or continue services under conditions that reasonably place the Photographer, team members, clients, participants, or photography equipment and property at risk of injury, damage, theft, or unsafe exposure.

The Photographer reserves the right to pause, modify, relocate, or discontinue services when conditions or conduct are reasonably considered unsafe. This may include, but is not limited to, dangerous environments, threatening or aggressive behavior, harassment, unsafe activities, severe weather or environmental conditions, interference with equipment, or failure to follow reasonable safety instructions.

Clients are responsible for the conduct of themselves and individuals participating in or attending their session or event. Specific remedies, payment obligations, and termination provisions related to unsafe or inappropriate conduct are governed by the applicable service agreement.
