THE CAPTURED CO. — SERVICE AGREEMENT

By booking services with The Captured Co. (“Photographer”), the client (“Client”) agrees to the following terms:

1. Booking & Payment

A 50% non-refundable retainer is required at the time of booking to secure your date.
The remaining balance is due 48 hours prior to the scheduled session.
Sessions will not be conducted without full payment received.
For specialty sessions (including minis or holiday sessions), full payment may be required at booking and is non-refundable.

2. Cancellations

Clients may request cancellation at least 48 hours prior to the scheduled session in writing.
All retainers and payments are non-refundable, unless otherwise approved at the Photographer’s discretion.
No-shows or cancellations within 48 hours result in full forfeiture of all payments.

3. Rescheduling

Clients are allowed up to two (2) reschedules based on Photographer availability.
A third reschedule request is not guaranteed and is subject to Photographer discretion.
Mini sessions may only be rescheduled at Photographer discretion.
Weather-related reschedules will be handled collaboratively.

4. Session Timing

Clients must arrive 10 minutes prior to the scheduled session.
Session time begins at the exact scheduled time, regardless of client arrival.
Late arrival may result in reduced session time without refund.

5. Deliverables

Image quantity and turnaround time vary based on selected package.
Sneak peeks are not guaranteed and depend on package selection.
Final galleries are delivered digitally via an online gallery.
RAW/unedited images are not provided.

6. Creative Control

The Photographer retains full creative control over:
Shooting style
Editing style
Image selection
Editing will reflect The Captured Co.’s signature style and branding.

7. Client Responsibilities

Client is responsible for:
Arriving prepared and on time
Communicating preferences prior to the session
Securing any required permits or permissions (if applicable)

8. Usage Rights

The Photographer retains full copyright ownership of all images.
Clients receive a personal use license.
Images may not be altered, filtered, or sold without written consent.
The Photographer may use images for:
Portfolio
Website
Social media
Marketing materials
(unless otherwise requested in writing)

9. Liability

The Photographer is not responsible for:
Missed shots due to client lateness or lack of cooperation
Unforeseen circumstances (weather, illness, emergencies, etc.)
In the rare event of total failure to deliver, liability is limited to a refund of payments made.

10. Travel Fees

Travel fees may apply for sessions outside of standard service areas.
Fees will be communicated prior to booking and added to the invoice.

11. Special Sessions / Promotional Offers

Promotional sessions (including minis, holiday sessions, and specialty offers):
Are non-refundable
May have limited rescheduling options
May include specific delivery timelines (e.g., holiday delivery dates)

12. Agreement

By submitting payment, the Client acknowledges they have read, understood, and agreed to all terms outlined in this agreement.
